סעיף 9 - הערות משתמשים, משוב והגשות אחרות

אם, לפי בקשתנו, תשלח/י הגשות ספציפיות מסוימות (למשל השתתפות בתחרויות) או ללא בקשה מאיתנו תשלח/י רעיונות יצירתיים, הצעות, תוכניות או חומרים אחרים, בין אם אונליין, בדואר אלקטרוני, בדואר רגיל או בדרך אחרת (כולם יחד: 'הערות'), את/ה מסכים/ה שאנו רשאים, בכל עת, ללא הגבלה, לערוך, להעתיק, לפרסם, להפיץ, לתרגם ולהשתמש בכל מדיום בכל הערה שתעביר/י אלינו. איננו מחויבים ולא נהיה מחויבים (1) לשמור על סודיות ההערות; (2) לשלם פיצוי עבור הערות כלשהן; או (3) להשיב להערות כלשהן. אנו רשאים, אך איננו מחויבים, לפקח, לערוך או להסיר תוכן שנקבע על פי שיקול דעתנו הבלעדי שהוא בלתי חוקי, פוגעני, מאיים, דיבתי, משמיץ, פורנוגרפי, מגונה או פוגעני באופן אחר, או מפר קניין רוחני של צד כלשהו או את תנאי השירות הללו. את/ה מסכים/ה שההערות שלך לא יפרו שום זכות של צד שלישי כלשהו, לרבות זכויות יוצרים, סימני מסחר, פרטיות, זכות פרסום או זכות אישית או קניינית אחרת. את/ה מסכים/ה עוד שההערות שלך לא יכילו חומר דיבתי או בלתי חוקי, פוגעני או מגונה, ולא יכילו כל וירוס מחשב או תוכנה זדונית אחרת שעלולה להשפיע בכל דרך על פעולת השירות או כל אתר קשור. אינך רשאי/ת להשתמש בכתובת דואר אלקטרוני כוזבת, להתחזות לאדם אחר, או להטעות אותנו או צדדים שלישיים לגבי מקור ההערות. את/ה האחראי/ת הבלעדי/ת לכל הערה שתכתוב/י ולדיוקה. איננו נושאים בכל אחריות או חבות לכל הערה שתפורסם על ידך או על ידי צד שלישי כלשהו.

סעיף 11 - שגיאות, אי-דיוקים והשמטות

סעיף 12 - שימושים אסורים

בנוסף לאיסורים אחרים המפורטים בתנאי השירות, חל עליך איסור להשתמש באתר או בתוכנו: (א) לכל מטרה בלתי חוקית; (ב) לשדל אחרים לבצע או להשתתף במעשים בלתי חוקיים כלשהם; (ג) להפר כל תקנה, כלל, חוק או צו מקומי בינלאומי, פדרלי, מחוזי או מדינתי; (ד) לפגוע או להפר את זכויות הקניין הרוחני שלנו או את זכויות הקניין הרוחני של אחרים; (ה) להטריד, להתעלל, להעליב, לפגוע, להשמיץ, להוציא דיבה, לזלזל, להפחיד או להפלות על רקע מגדרי, נטייה מינית, דת, מוצא אתני, גזע, גיל, מוצא לאומי או מוגבלות; (ו) למסור מידע כוזב או מטעה; (ז) להעלות או להעביר וירוסים או כל סוג אחר של קוד זדוני שישמש או עלול לשמש בכל דרך שתשפיע על הפונקציונליות או הפעולה של השירות או של כל אתר קשור, אתרים אחרים או האינטרנט; (ח) לאסוף או לעקוב אחר המידע האישי של אחרים; (ט) לשלוח ספאם, פישינג, פארמינג, פרטקסט, ספיידר, קראול או סקרייפ; (י) לכל מטרה מגונה או בלתי מוסרית; או (יא) להפריע או לעקוף את תכונות האבטחה של השירות או של כל אתר קשור, אתרים אחרים או האינטרנט. אנו שומרים לעצמנו את הזכות להפסיק את השימוש שלך בשירות או בכל אתר קשור בגין הפרת איזה מהשימושים האסורים.

סעיף 13 - ויתור על אחריות; הגבלת חבות

איננו מבטיחים, מצהירים או מתחייבים כי השימוש שלך בשירות שלנו יהיה רציף, בזמן, מאובטח או נקי משגיאות. איננו מתחייבים כי התוצאות שעשויות להתקבל מהשימוש בשירות יהיו מדויקות או אמינות. את/ה מסכים/ה שמעת לעת אנו עשויים להסיר את השירות לתקופות זמן בלתי מוגבלות או לבטל את השירות בכל עת, ללא הודעה מוקדמת. את/ה מסכים/ה במפורש שהשימוש שלך בשירות, או אי-יכולתך להשתמש בו, הוא על אחריותך הבלעדית. השירות וכל המוצרים והשירותים הניתנים לך באמצעות השירות (למעט כפי שצוין במפורש על ידינו) מסופקים "כמות שהם" (As Is) ו-"ככל שיהיו זמינים" (As Available) לשימושך, ללא כל מצג, אחריות או תנאים מכל סוג שהוא, בין מפורש ובין משתמע, לרבות כל האחריות או התנאים המשתמעים של סחירות, איכות סחירה, התאמה למטרה מסוימת, עמידות, בעלות ואי-הפרה.

בשום מקרה ChiorJewelry, המנהלים, נושאי המשרה, העובדים, החברות הבנות, הסוכנים, הקבלנים, המתמחים, הספקים, ספקי השירות או נותני הרישיון שלנו לא יהיו אחראים לכל פגיעה, הפסד, תביעה או כל נזק ישיר, עקיף, מקרי, עונשי, מיוחד או תוצאתי מכל סוג שהוא, לרבות, ללא הגבלה, אובדן רווחים, אובדן הכנסות, אובדן חסכונות, אובדן נתונים, עלויות החלפה או כל נזק דומה אחר, בין אם מבוסס על חוזה, עוולה (לרבות רשלנות), חבות חמורה או אחרת, הנובעת מהשימוש שלך בשירות כלשהו או במוצרים כלשהם שנרכשו באמצעות השירות, או בגין כל תביעה אחרת הקשורה בדרך כלשהי לשימוש שלך בשירות או בכל מוצר, לרבות, אך לא רק, שגיאות או השמטות בתוכן כלשהו, או כל הפסד או נזק מכל סוג שהוא שנגרם כתוצאה מהשימוש בשירות או בכל תוכן (או מוצר) שפורסם, הועבר או הועמד לרשותך בדרך אחרת באמצעות השירות, גם אם הודענו על האפשרות שלהם. מכיוון שמדינות או סמכויות שיפוט מסוימות אינן מתירות החרגה או הגבלת חבות בגין נזקים תוצאתיים או מקריים, במדינות או בסמכויות שיפוט כאמור, החבות שלנו תוגבל במידה המקסימלית המותרת על פי חוק.

סעיף 14 - שיפוי

את/ה מסכים/ה לשפות, להגן ולפטור מאחריות את ChiorJewelry וחברות האם, החברות הבנות, החברות הקשורות, השותפים, נושאי המשרה, המנהלים, הסוכנים, הקבלנים, נותני הרישיון, ספקי השירות, קבלני המשנה, הספקים, המתמחים והעובדים שלנו, מפני כל תביעה או דרישה, לרבות שכר טרחת עורכי דין סביר, שתוגש על ידי צד שלישי כלשהו עקב או כתוצאה מהפרתך את תנאי שירות אלה או המסמכים שהם כוללים בהפניה, או הפרתך כל חוק או זכויות של צד שלישי.

סעיף 15 - פרידות התנאים

במקרה שבו נקבע כי הוראה כלשהי מתנאי שירות אלה אינה חוקית, בטלה או בלתי ניתנת לאכיפה, הוראה כאמור תהיה ניתנת לאכיפה במידה המלאה המותרת על פי החוק החל, והחלק הבלתי ניתן לאכיפה ייחשב כאילו נפרד מתנאי שירות אלה. קביעה כאמור לא תשפיע על התוקף והאכיפה של שאר ההוראות הנותרות.

סעיף 16 - סיום

ההתחייבויות והחבויות של הצדדים שנצברו לפני מועד הסיום ימשיכו להתקיים לאחר סיום הסכם זה לכל המטרות. תנאי שירות אלה בתוקף אלא אם כן ועד אשר יסויימו על ידיך או על ידינו. את/ה רשאי/ת לסיים תנאי שירות אלה בכל עת על ידי הודעה לנו כי אינך מעוניין/ת עוד להשתמש בשירותים שלנו, או כאשר את/ה מפסיק/ה להשתמש באתר שלנו. אם לפי שיקול דעתנו הבלעדי נכשלת, או אנו חושדים שנכשלת, למלא אחר תנאי או הוראה כלשהי מתנאי שירות אלה, אנו גם רשאים לסיים הסכם זה בכל עת ללא הודעה מוקדמת ואת/ה תישא/י בחבות עבור כל הסכומים המגיעים עד וכולל תאריך הסיום; ו/או בהתאם לכך אנו עשויים למנוע ממך גישה לשירותים שלנו (או לכל חלק מהם).

סעיף 17 - ההסכם המלא

כישלון שלנו לממש או לאכוף זכות או הוראה כלשהי מתנאי שירות אלה לא יהווה ויתור על זכות או הוראה כאמור. תנאי שירות אלה וכל מדיניות או כללי הפעלה שפורסמו על ידינו באתר זה או ביחס לשירות מהווים את כלל ההסכמה וההבנה בינך לבינינו ומסדירים את השימוש שלך בשירות, ומחליפים כל הסכם, תקשורת והצעה קודמים או בני זמננו, בין בעל פה ובין בכתב, בינך לבינינו (לרבות, אך לא רק, גרסאות קודמות של תנאי השירות). כל עמימות בפרשנות תנאי שירות אלה לא תפורש נגד הצד המנסח.

סעיף 18 - החוק החל

תנאי שירות אלה וכל הסכמים נפרדים שעל פיהם אנו מספקים לך שירותים יהיו כפופים לחוקי מדינת ישראל ויפורשו לפיהם.

סעיף 19 - שינויים בתנאי השירות

תוכל/י לעיין בגרסה העדכנית ביותר של תנאי השירות בכל עת בעמוד זה. אנו שומרים לעצמנו את הזכות, על פי שיקול דעתנו הבלעדי, לעדכן, לשנות או להחליף כל חלק מתנאי שירות אלה על ידי פרסום עדכונים ושינויים באתר האינטרנט שלנו. באחריותך לבדוק את אתר האינטרנט שלנו מעת לעת כדי להתעדכן בשינויים. המשך השימוש שלך או הגישה שלך לאתר האינטרנט שלנו או לשירות בעקבות פרסום שינויים כלשהם בתנאי שירות אלה מהווה הסכמה לשינויים אלה.
